What are the New Rules for LMIA in Canada 2022?

In recent times there are some changes in the LMIA process. According to the new updates, the job positions are now divided in two broad categories: high wage jobs and low wage jobs. If the salary is equal to or more than the median salary in the area where the job will be actually performed, it is high wage job and if the salary is less than the median salary, it is low-wage job. There has been a significant increase in the application fees as well which is now 1000 dollars per worker.

What are the Requirements for LMIA? 

The hiring of High Wage Workers: When an employer hires a temporary foreign worker at a high wage that is more than the median wage, the employer has to introduce a transition plan which is an important requirement for them.

Hiring Low-Wage Workers: When an employer hires a temporary foreign worker at a low wage, a transition plan is not needed. There is a limit to the number of low wage workers that a business can employ. When an employer has more than 10 workers working, they will have only up to a 10% limit to employ low-wage TFW.

The hiring of workers if LMIA is needed: A copy of the confirmation letter is to be provided to each TFW once the LMIA has been issued, and then they must apply for a work permit.

The hiring of workers if LMIA is not needed: Through (IMP) International Mobility Program, an employer can hire TFW without LMIA. The employers are needed to pay an employer compliance fee and from the Employer Portal, an offer of employment form is to be submitted.

LMIA Processing Time: Due to a large number of LMIA applications, there are delays in the processing times, especially in the TFW program. The recent processing times for each LMIA program are given below-
